http://www.courthousenews.com/2010/01/05/lake-travis-drought.jpgA dentist who owns property on Lake Travis claims the Lower Colorado River Authority is draining the lake in violation of its duty to preserve it for the benefit of the public. Robert Wynne claims the River Authority has reduced the water level so much that boats cannot even reach the water, much less navigate through it, and that it's done this to support its own coal- and gas-fired electric generating plants on or near the Colorado River.

The Lower Colorado River Authority is not authorized under the Texas Constitution "to own or operate a coal or gas-fired generating plants at all," Wynne says, though that has become its primary focus.

Wynne claims that though $3 billion of LCRA's $3.7 billion in assets come from the electric plants, and more than $1 billion of its $1.2 billion in revenue is derived from selling electricity power from the plants, the LCRA is not authorized to "sell" anything at all.

Wynne seeks a declaration that the LCRA must "maintain a water level in Lake Travis at no less that six hundred sixty feet above sea level." and it is not authorized to operate gas or coal fired electrical generating plants. He is represented by Kenneth Wynne of Houston.
