Fight over Cowboys game leads to shooting

A 66-year-old Austin man is accused of shooting his daughter's boyfriend after a dispute about watching the Dallas Cowboys game Sunday, according to an arrest affidavit filed Tuesday.

Robert "Jugg" Johnson is facing a charge of aggravated assault with a deadly weapon, a second-degree felony, after police say he shot Darius Maxwell at his home Monday in the 1700 block of West St. Johns Avenue in North Austin.

Maxwell had tried to watch the game at Johnson's home Sunday, but Johnson told him he couldn't, and the two argued, the affidavit said. Police were called to the home, and Maxwell left, the affidavit said.

Maxwell returned Monday and was shot during another altercation, the affidavit said. Maxwell told police that Johnson had called him a racial slur, the affidavit said.

"The old man threatened me several time today and told me that he would put something on me that would lay me down for good," the affidavit quotes Maxwell as saying. "I told him, if he was gonna do that he better make sure I don't get up. That's when he pulled the gun from his back pocket and shot me."

It is not known how seriously Maxwell was injured.
